Accused sunlander rapist remanded in custody in South Australian Supreme Court

A former South Australian sunlander accused of rape, indecent assault and a number of sex offences on girls in Melbourne has been remanded in custody for sentencing on Friday.

The alleged victim says she was sexually assaulted in his back yard in the inner west in March last year.

She is now in serious condition in a Melbourne hospital with head, chest and stomach injuries.

After being granted bail to come to Australia earlier this month, Justice John Parker said the complainant was the only person at the crime scene to claim that the accused didn't know the alleged victim was vulnerable because of her appearance.

"It must have been a massive emotional reaction that the complainant never experienced," Justice Parker said.

"She had to come to grips with the fact that she had been sexually assaulted."

He said this was because the accused didn't know the young woman's identity — even though she was seen with her when she was first told of her alleged attackers.

"That means that it is likely the defendant would never have realised that a girl as young as 14 was being approached by men of such an age," Justice Parker said.

A trial date has yet to be set.

Justice Parker has now ordered he be remanded in custody until February.

A third defendant in the case, 21-year-old Jeremy Mair, was remanded after admitting assault and indecency with a child.

Defence lawyer Robert Poulton said the charge against the man who assaulted the woman would be dropped.

"It just has to do with the age of the girl," he said.

The third man, a young man, has since been released on bail.

"If there's another fire, it's no longer a controlled burning and it would have to stop before the fire is contained to the fire pit," says David Zweig, a lawyer with the Natural Resources Defense Council, which advocates for an end to controlled burns. "It's a significant change."

The change does provide a loophole for someone under 18 to get a permit for the controlled burns. However, the law also applies only if there is an existing fire or other disaster that threatens the community and where there is a danger to children.
